Fraudulent Voting Threat Expands

Serious questions concerning potential voter fraud in the Iowa Democrat caucus have reinvigorated claims of ballot and registration misdeeds across the nation. Examples of significant problems with accurate voter registration issues, including the registration of illegal aliens, abound from coast to coast.

True the Vote (TTV) has released a report on its recent discovery of thousands of duplicate voter registrations in North Carolina’s ten largest counties and the coordinated attempts by left-leaning political organizations to threaten the NC counties with new litigation and hostile document demands in a failed effort to stall lawful maintenance efforts.

In response to True the Votes efforts, those organizations, according to TTV, attempted to stall or prevent counties from cleaning voter records in accordance with state and federal requirements. TTV founder Catherine Engelbrecht has stated “For generations, leftist political organizations…have bullied our county election offices in order to engineer partisan election outcomes. It should come as no surprise that the same groups who would block simple maintenance efforts are also outspoken critics of North Carolina’s voter ID law. True the Vote holds election integrity above political advantage. As the Supreme Court of the United States recognized when it upheld the constitutionality of Indiana’s voter identification law in 2008, flagrant examples of voter fraud ‘have been documented throughout this Nation’s history by respected historians and journalists.’ Those examples ‘demonstrate that not only is the risk of voter fraud real but that it could affect the outcome of a close election.”

Judicial Watch adds: “The sad truth is that our nation’s recent history consists of far too many elections which have been called into question due to allegations of incompetence and outright misconduct.  Most notable have been the abuses by ACORN and its state organizations, which in 2008 were implicated in at least 35 well-documented election fraud schemes in 17 states, leading to multiple convictions, fines, and even prison.  And while ACORN activities have become so nefarious it was forced to disband (though, in reality, spinoff groups have survived) Project Vote, an affiliate of ACORN, remains very active…”

National Review reports that “Several well-funded organizations — including the League of Women Voters and the NAACP — are fighting efforts to prevent non-citizens from voting illegally in the upcoming presidential election. And the United States Department of Justice, under the direction of Attorney General Loretta Lynch, is helping them.  On February 12, these groups filed a lawsuit in D.C. federal court seeking to reverse a recent decision by the U.S. Election Assistance Commission (EAC). The Commission’s decision allows Kansas and other states, including Arizona and Georgia, to enforce state laws ensuring that only citizens register to vote when they use a federally designed registration form.”
A Congressional Research Service study noted that “The Help America Vote Act requires that certain voters who had registered by mail present a form of identification from a list specified in the act. States vary greatly in what identification they require voters to present, ranging from nothing beyond the federal requirement to photographic identification for all voters. A number of states enacted laws in recent years to require photo ID to vote, which resulted in a series of state court challenges and rulings. In the 109th Congress, the House passed legislation to require photo identification and proof of citizenship when voting in federal elections, but no further action followed. The U.S. Supreme Court has upheld an Indiana statute requiring photo identification for voting…Given the problems some states have had, the increase in new-voter registration in recent elections, and recent closely contested presidential elections, issues associated with voter registration systems have become more prominent. Among them are questions about the integrity and accuracy of the statewide systems, the validity of new registrations, concerns about various kinds of fraud and abuse, and the impacts of attempts to challenge the validity of voters’ registrations at polling places.”

Research confirms massive illegal voting

Non-citizens are voting in U.S. elections, according to an Old Dominion University study.

The analysis examined participation rates by non-citizens using a nationally represented sample that included non-citizen immigrants. It found that “some non-citizens participate in U.S. elections, and that this participation has been large enough to change meaningful election outcomes including electoral college votes and Congressional elections.  Non-citizen votes likely gave Senate Democrats the pivotal 60th vote needed to overcome filibusters in order to pass health care reform and other Obama priorities in the 111th Congress.”

Other research indicates how fraudulent voting, including voting by illegal immigrants, felons, and additional ineligibles, occurs. Reasons include the poor maintenance of voter registration rolls, the lack of viable verification procedures when individuals register to vote, and the Department of Justice’s militant stance against voter ID.

True the Vote  has found that 136 counties across 21 U.S. states have bloated voter rolls. The counties have failed to make reasonable efforts to address the problem.

According to True the Vote Founder Catherine Engelbrecht, “Bloated voter rolls hurt everyone. Deceased voters aren’t removed, duplicate registrations aren’t revoked and the records of voters who’ve relocated aren’t corrected. Low verification standards, like absence of voter ID, add to the confusion. Bloated rolls create the ideal environment for identity theft and voter fraud. The Harvard study was an academic project involving teams of researchers located throughout the United States. The CCES findings support the allegations that enough illegal votes were cast in 2008 to turn the tide in close races to favor Democratic candidates and provide them with victories…Though the Harvard study was originally designed to dispel claims of widespread voter fraud, the results proved otherwise. Illegal immigrants voting: a campaign 2016 issue

A recent Rasmussen poll  indicates that a majority of Democrats believe illegal aliens should be allowed to vote. According to the poll, “one-out-of-three Likely U.S. Voters (35%) now believes that illegal immigrants should be allowed to vote if they can prove they live in this country and pay taxes. Sixty percent (60%) disagree, while five percent (5%) are undecided.  Fifty-three percent (53%) of Democrats think tax-paying illegal immigrants should have the right to vote. Twenty-one percent (21%) of Republicans and 30% of voters not affiliated with either major political party agree… Women are more supportive than men of letting tax-paying illegal immigrants vote, but the two are in general agreement that the size of voting districts should be determined by counting only the number of eligible voters.” (The Supreme Court will soon decide whether illegals should be counted in determining the size of districts.)

Earlier this year, state election officials testified before Congress that President Obama’s    temporary deportation amnesty plans would make it easier for illegals to vote, since the illegals would have access to social security cards and drivers licenses.

The issue has been introduced into the 2016 Presidential campaign by Hillary Clinton, who has made allegations of voter suppression supposedly at the hands of Republicans.  On May 31, according to the New York Times, Clinton “accused Republicans including her potential rivals Jeb Bush, Scott Walker and Rick Perry of ‘deliberately trying to stop’ young people and minorities — both vital Democratic constituencies — from exercising their right to vote. She called for automatic voter registration in every state when young people turn 18, criticized Republican-sponsored voting laws in North Carolina, Texas and Wisconsin, and urged Congress to take immediate action to reinstate an important provision of the Voting Rights Act that she said the Supreme Court had “eviscerated” in a 2013 ruling…In addition to areas she said needed to be addressed, like easier online registration, shorter lines at polling precincts and a minimum of 20 days for early voting before an election, Mrs. Clinton called for a nationwide law modeled on one recently passed in Oregon that automatically adds voters to the rolls when they turn 18, using driver’s license data. Residents would have to opt out to avoid being added to the voter rolls.”

Those tolerant of illegal immigrant voting often camouflage their arguments by stating that voter ID laws, meant to discourage unlawful voting of any sort, are being aimed at young people or minorities. There is no evidence to back up that assertion.  Indeed, Judicial Watch  has found that in a case study in North Carolina, minority voter turnout actually increased since the passage of North Carolina’s election integrity bill.

Fraudulent voting is not confined to illegal immigrants. In 2012, reports the Washington Examiner,  Wendy Rosen, The Democratic candidate for Maryland’s 1st Congressional District , was forced to end her candidacy  after it was discovered that she committed voter fraud by casting a ballot in both Maryland and Florida in multiple political contests. Her story is similar to an incident in Connecticut reported by the Washington Times. “State Rep. Christina Ayala of Connecticut, a Democrat from Bridgeport, was caught voting early and often. She has been charged with 19 felony counts. Preventing illegal immigrants from unlawfully voting is not an easy task. The Washington Times  reported that “secretaries of state from Ohio and Kansas said they won’t have the tools to sniff out illegal immigrants who register anyway, ignoring stiff penalties to fill out the registration forms that are easily available at shopping malls, motor vehicle bureaus and in curbside registration drives. Anyone registering to vote attests that he or she is a citizen, but Ohio Secretary of State Jon Husted said mass registration drives often aren’t able to give due attention to that part, and so illegal immigrants will still get through. Kansas Secretary of State Kris W. Kobach said even some motor vehicle bureau workers automatically ask customers if they want to register to vote, which some noncitizens in the past have cited as their reason for breaking the law to register.”

Unlawful voting by illegal immigrants poses threats to U.S. electoral integrity

State officials are raising an alarm about the potential for noncitizen, unlawful voting to substantially affect upcoming elections.  This is a major issue when considering the significant numbers of illegals entering and remaining in the United States, particularly during the tenure of the Obama Administration

An example is Ohio’s Secretary of State, Jon Husted.  In a letter  to the White House, Husted noted:

“   I write regarding the consequences the recent Immigration Accountability Executive Actions may have on the administration of federal and state elections. Consistent with federal and state law, states are responsible for ensuring the integrity of our elections. As a swing state with access to voting that is already expansive, Ohio takes this responsibility very seriously. In spite of our diligence maintaining accurate voter registration rolls, however, the recent executive actions could jeopardize their integrity by making it much easier for people who are not U.S. citizens to illegally register and cast ballots. As the chief elections official for the state of Ohio, I simply cannot allow this expanding loophole to go unaddressed.

“The source of the problem is that the recent executive actions enable millions of non-U.S. citizens to obtain valid Social Security numbers and driver’s licenses. Under federal law, any person with a valid Social Security number or driver’s license can register to vote, so long as they attest to their eligibility to do so.1 As a result, the recent executive actions dramatically expand the opportunities for illegal voter registrations in Ohio and other states by non-citizen voters who have valid forms of identification and who willingly or negligently affirm their eligibility to vote. This problem is especially serious in the context of third-party voter registration drives, which are prevalent in Ohio and other states. Such drives occur outside of the presence of election officials who could explain that citizenship—not mere lawful presence—is a fundamental requirement for registering to vote and who can caution non-citizens against erroneous attestations.

“In short, by enabling millions of non-citizens to access valid forms of the types of identification required to register to vote, the recent executive actions have increased the risk that non-citizens may illegally register to vote and vote in our elections…

“Voter confidence is paramount in all states, but magnified in swing states where our democratic system is put under the national and world microscope. If the recent executive actions remain in force, it is imperative that state elections officials be given real-time access to accurate, searchable, electronic databases of non-citizens who have valid Social Security numbers in order to distinguish between citizens and lawfully-present non-citizens…”

The Federal government under President Obama has not responded to states concerns about unlawful voting, particularly in relation to unlawful aliens. In a case pending before the U.S. Supreme Court, Kris Kobach, Kansas’s Secretary of States, challenges the U.S. Election Assistance Commission refusal to deferto the states’ determination that provision of documentary evidence of citizenship is necessary to enforce the states’ voter qualifications.

“In 2004, Arizona voters approved Proposition 200, which addresses the serious problem of noncitizen registration and voting by requiring applicants to provide documentary evidence of citizenship in order to register and vote in federal and state elections. A 2004 study by the Federation for American Immigration Reform  noted:

“There is evidence that noncitizens are being registered and casting votes, but due to the laxity in checking the eligibility of registrants and voters the full extent of the problem is not known. One of the most extensively documented cases of illegal voting was in California in 1996. Loretta Sanchez, a Democrat, defeated Republican incumbent Robert Dornan by 984 votes. Dornan called for an investigation of alleged illegal voting by noncitizens. According to Congressional Quarterly…’Task force Chairman [U.S. Representative] Vernon J. Ehlers, R-Mich., said investigators had found concrete evidence of 748 illegal votes by noncitizens…’

“A lack of attention to the phenomenon of noncitizen voting and a failure to impose penalties against those who cast votes fraudulently has rendered laws against such activity meaningless. It is a federal crime to vote illegally. However, in all cases that have been documented of illegal voting in recent years there apparently has never been a prosecution and, therefore, no penalty has been assessed. Some of the cases involved the discovery of illegal voting by aliens during investigation of applicants for U.S. citizenship. Even though illegal voting could have made the alien ineligible for U.S. citizenship, the disqualification was waived. Therefore, the penalty in the law against illegal voting could be likened to a paper tiger.”
