Kerry violates Logan Act

A furor has arisen about former Secretary of State John Kerry’s meetings with Iranian government officials and others regarding the Trump Administration’s decision to pull out of the Iran nuclear deal. Kerry’s tenure as Secretary of State ended in January of 2017. The issue has been simmering for some time. The Boston Globe reported last May that Kerry met twice with Iranian Foreign Minister Javad to discuss the nuclear deal.

Inadvertently,  Iranian officials, describing those meetings, laid out the clear legal groundwork for an indictment under the Logan Act, which criminalizes negotiation by unauthorized persons with foreign governments having a dispute with the United States. Iranian Foreign Ministry spokesman Bahram Qassemi, quoted in Iran’s FARS news Agency “We don’t see the U.S. just as Mr. Trump; the United States is not just the current ruling administration and there are many figures who have different views on international and regional issues…”

Qassemi failed to understand that, indeed, the United States Government does have just one entity at a time that is legally permitted to conduct foreign affairs. Current Secretary of State Michael Pompeo, in an interview, stated: “what Secretary Kerry has done is unseemly and unprecedented. This is a former secretary of state engaged with the world’s largest state sponsor of terror, and according to him…You don’t have to take my word for it. … He was talking to them. He was telling them to wait out this administration. You can’t find precedent for this in U.S. history, and the secretary ought not – Secretary Kerry ought not to engage in that kind of behavior. It’s inconsistent with what foreign policy of the United States is, as directed by this President, and it is beyond inappropriate for him to be engaged in this. I remember, I saw him. I saw him in Munich at the Security Conference…”

President Trump concurred in Secretary Pompeo’s concerns: “John Kerry had illegal meetings with the very hostile Iranian Regime, which can only serve to undercut our great work to the detriment of the American people. He told them to wait out the Trump Administration! Was he registered under the Foreign Agents Registration Act? BAD!”

Iran Nuclear Deal, North Korean talks: The Difference

There is a remarkable contrast between the current state of the North Korean negotiations and the recently decertified Iran Nuclear Agreement.

The flaws in the Iran deal are glaringly obvious. Even if the Mullahs faithfully complied to its provisions, they would still have the right to build atomic bombs within a decade. Malin and Zhang have been proven incorrect, as were the extensive number of critics that decried President Trump’s “fire and fury” comments.

Obama was personally invested in the Iran deal. In essence, he placed his legacy above the needs of the nation.  Trump, despite the political gains he could reap from a North Korea deal, has repeatedly stressed that he is willing to walk away if the talks don’t produce good results, placing him in a far better negotiating position than his predecessor.

A disturbing attitude from America’s Commander-in-Chief and his appointees was in full view during the past week.

This pointless and counterproductive move gave rise to the conditions which resulted in the chaos that gave rise to the Benghazi attack, just as the President’s reckless and premature withdrawal of troops from Iraq gave rise to the conditions that allowed ISIS to come to power which, in turn, resulted in Iran’s huge growth of influence in the Middle East as the only force on the ground willing to take them on.

At the White House, Mr. Obama threatened to veto what is, essentially, his own defense spending bill in an effort to close the Guantanamo Bay prison, where terrorists are housed in a setting where no American civilians can be harmed. He also seeks to use his veto threat as a way of forcing Congress to comply with his effort to shift funds from the defense budget, which is substantially smaller than when he took office, (and accounting for only 18% of the federal budget and a significantly lower share of GDP than it has for decades) to entitlements (although not social security) which have expanded greatly, without any success in reducing poverty.  Speaking of things Cuban, the President has also failed to explain why, one month after Havana agreed to allow the Russian Navy to return to its cold war base on the island nation, he, strangely, rewarded this threatening action by restoring relations with Castro’s government.

North Korea and Iran move forward with advanced missile and nuclear technology. Obama’s Strange War

The day after the President Obama announced enhanced airstrikes against ISIS, 13 years into America’s long march against Islamic extremism, Secretary of State John Kerry declared we were not at war with ISIS but “What we are doing is engaging in a very significant counter-terrorism operation, and it’s going to go on for some period of time.”

This was followed by the British Foreign Secretary Philip Hammond telling reporters at a news conference in Berlin: Let me be clear; Britain will not be taking part in any air strikes in Syria.”  He said London won’t be “revisiting” the issue after Parliament decided last year against participating in air strikes.  Number 10 Downing Street then had to walk that back by saying that P.M. He has tried to convince us that he waited for a new regime in Bagdad and now that he has it no one can really say if it is the real deal or not.  In Iraq, it is a new Sunni Awakening that is needed along with an Iraqi army that can and will fight. In Syria it is a collection of insurgents, some with al-Qaeda ties, who Mr. Obama just weeks ago demeaned as “Doctors, Farmers and Pharmacists” whom he would be stupid to arm.  Then his core principle was “don’t do stupid stuff””.  Now it is “no safe haven” for those who try to kill us.  The truth is that nobody knows what this is or where this is going and that in the long run is the biggest danger of it all.

No American should be sent into harms way if the ultimate objective is not complete and total victory.  Anything less is immoral and illogical.  A three year campaign with the finale left to a new President is yet another example of his propensity to fit square pegs into round holes.  It is a graduate studies exercise devoid of the essence of or the unpredictability of the reality of war.  Why three years?  Three years will allow this cancer to metastasize and grow until ISIS is not just part of Islam but is Islam itself.
