More so than any other form of entertainment or athletic competition, it honored tradition. It was so ingrained in the American character that during the Second World War, its statistics and trivia were employed by front-line troops for security purposes.

The sport’s current leadership, and even many of the players, fail to comprehend what baseball contributes to a country suffering from deep divisions. Rather than standing above the fray and providing a means to keep some common ground and maintain a forum for unity, it has descended into just another venue for partisan debate. It does so at its own peril, and ours.

This isn’t just a problem brought about by those who run the sport. Sports writers, like many news journalists, apparently care less about objectively reporting the facts than virtue signalling and making ideological points.

Baseball embraces politics at its own peril. Consider the NFL’s losses following its decision to stray into the field. The National Football League took a significant financial and popularity loss following its surrender to players who sought to interject politics into their sport.

Not everything has to be about politics. Yet, Major League Baseball’s decision to move its All-Star event from Atlanta to Denver signals to fans that politics is more important than the unifying tonic the game offers. It’s not just the MLB organization. Some individual players, such as the New York Yankees Aaron Hicks, who chose not to play after a tragic interracial incident, have used the game to push their perspective.

The move to transfer the All-Star game from Atlanta to Denver illustrates the utter lack of sophistication of these would-be politicos. Atlanta is minority-majority city; Denver is a Caucasian-majority city.  The protested legislation which prompted the idea did little more than provide more security and transparency to Georgia’s electoral system. Ironically, baseball itself practices one form of security, the requirement of identity when picking up reserved tickets, that has been a flashpoint in the national debate over ballot security.

There may be more to the story.  Shortly before MLB rendered its inappropriate decision, it announced that it had signed a deal with a Chinese company. China, through its vast financial influence within the U.S., has done all it can to encourage racial animosity. MLB has cast hungry eyes on the 1.3 billion population of China for over a decade, having opened an office there in 2007. CNN  reports that in 2020,  “MLB partnered with China Education TV, a national network, to air select MLB shows and games. CETV reaches nearly one billion viewers.” Beijing has a significant history of working with Black Lives Matter.

The social fabric of a nation is comprised of many important facets. Making them all subordinate to politics is a terrible move.

Open Letter from Retired Generals and Admirals

Our Nation is in deep peril. We are in a fight for our survival as a Constitutional Republic like no other time since our founding in 1776. The conflict is between supporters of Socialism and Marxism vs. supporters of Constitutional freedom and liberty. 

During the 2020 election an “Open Letter from Senior Military Leaders” was signed by 317 retired Generals and Admirals and, it said the 2020 election could be the most important election since our country was founded. “With the Democrat Party welcoming Socialists and Marxists, our historic way of life is at stake.” Unfortunately, that statement’s truth was quickly revealed, beginning with the election process itself. 

Without fair and honest elections that accurately reflect the “will of the people” our Constitutional Republic is lost. Election integrity demands insuring there is one legal vote cast and counted per citizen. Legal votes are identified by State Legislature’s approved controls using government IDs, verified signatures, etc. Today, many are calling such commonsense controls “racist” in an attempt to avoid having fair and honest elections. Using racial terms to suppress proof of eligibility is itself a tyrannical intimidation tactic. Additionally, the “Rule of Law” must be enforced in our election processes to ensure integrity. The FBI and Supreme Court must act swiftly when election irregularities are surfaced and not ignore them as was done in 2020. Finally, H.R.1 & S.1, (if passed), would destroy election fairness and allow Democrats to forever remain in power violating our Constitution and ending our Representative Republic. 

Aside from the election, the Current Administration has launched a full-blown assault on our Constitutional rights in a dictatorial manner, bypassing the Congress, with more than 50 Executive Orders quickly signed, many reversing the previous Administration’s effective policies and regulations. Moreover, population control actions such as excessive lockdowns, school and business closures, and most alarming, censorship of written and verbal expression are all direct assaults on our fundamental Rights. We must support and hold accountable politicians who will act to counter Socialism, Marxism and Progressivism, support our Constitutional Republic, and insist on fiscally responsible governing while focusing on all Americans, especially the middle class, not special interest or extremist groups which are used to divide us into warring factions. 

Additional National Security Issues and Actions: 

• Open borders jeopardize national security by increasing human trafficking, drug cartels, terrorists entry, health/CV19 dangers, and humanitarian crises. Illegals are flooding our Country bringing high economic costs, crime, lowering wages, and illegal voting in some states. We must reestablish border controls and continue building the wall while supporting our dedicated border control personnel. Sovereign nations must have controlled borders.

• China is the greatest external threat to America. Establishing cooperative relations with the Chinese Communist Party emboldens them to continue progress toward world domination, militarily, economically, politically and technologically. We must impose more sanctions and restrictions to impede their world domination goal and protect America’s interests. 

• The free flow of information is critical to the security of our Republic, as illustrated by freedom of speech and the press being in the 1st Amendment of our Constitution. Censoring speech and expression, distorting speech, spreading disinformation by government officials, private entities, and the media is a method to suppress the free flow of information, a tyrannical technique used in closed societies. We must counter this on all fronts beginning with removing Section 230 protection from big tech. 

• Re-engaging in the flawed Iran Nuclear Deal would result in Iran acquiring nuclear weapons along with the means to deliver them, thereby upsetting Mideast peace initiatives and aiding a terrorist nation whose slogans and goals include “death to America” and “death to Israel” . We must resist the new China/Iran agreement and not support the Iran Nuclear Deal. In addition, continue with the Mideast peace initiatives, the “Abraham Accords,” and support for Israel. 

• Stopping the Keystone Pipeline eliminates our recently established energy independence and causes us to be energy dependent on nations not friendly to us, while eliminating valuable US jobs. We must open the Keystone Pipeline and regain our energy independence for national security and economic reasons. 

• Using the U.S. military as political pawns with thousands of troops deployed around the U.S. Capitol Building, patrolling fences guarding against a non-existent threat, along with forcing Politically Correct policies like the divisive critical race theory into the military at the expense of the War Fighting Mission, seriously degrades readiness to fight and win our Nation’s wars, creating a major national security issue. We must support our Military and Vets; focus on war fighting, eliminate the corrosive infusion of Political Correctness into our military which damages morale and war fighting cohesion. 

• The “Rule of Law” is fundamental to our Republic and security. Anarchy as seen in certain cities cannot be tolerated. We must support our law enforcement personnel and insist that DAs, our courts, and the DOJ enforce the law equally, fairly, and consistently toward all. 

• The mental and physical condition of the Commander in Chief cannot be ignored. He must be able to quickly make accurate national security decisions involving life and limb anywhere, day or night. Recent Democrat leadership’s inquiries about nuclear code procedures sends a dangerous national security signal to nuclear armed adversaries, raising the question about who is in charge. We must always have an unquestionable chain of command. 

Under a Democrat Congress and the Current Administration, our Country has taken a hard left turn toward Socialism and a Marxist form of tyrannical government which must be countered now by electing congressional and presidential candidates who will always act to defend our Constitutional Republic. The survival of our Nation and its cherished freedoms, liberty, and historic values are at stake.

We urge all citizens to get involved now at the local, state and/or national level to elect political representatives who will act to Save America, our Constitutional Republic, and hold those currently in office accountable. The “will of the people” must be heard and followed.

Handcuffing the Police

It is no secret that crime in New York City has risen at an alarming rate, in a short period of time.  As reported by the New York Post, “(t)he number of shootings soared 97% from 777 in 2019 to 1,531 in 2020 and murders jumped by 44% from 319 to 462, according to the NYPD…(b)urglaries also shot up 42% from 10,909 to 15,463 and car thefts soared by 67% from 5,422 to 9,038, officials said.” 

New York’s ABC affiliate, Eyewitness News, reports that “(i)n the (first) 11 months of 2020, shootings in New York City…surged to levels unseen in years…(w)hile overall crime overall remains flat, the number of shootings increased again in November, this time by 112%…Police say there were 115 shootings (in November of 2020) vs. 51 in November of 2019.” 

And just what is the New York City Council doing to control this extreme surge in violent crime? “The New York City Council moved to end qualified immunity for Police Officers…making it the first big city in the nation to do so.”   

The legislation, which awaits Mayor Bill DeBlasio’s signature, amends the New York City Administrative Code to repeat the protections against unreasonable searches and seizures enshrined in the 4th Amendment to the United States Constitution.  There is also the addition of the right to bring a civil action; “A person aggrieved may make a claim…in any court of competent jurisdiction by filing a complaint setting forth facts pertaining to the deprivation of any right created, granted or protected by (this section) and requesting such relief as such person aggrieved considers necessary to insure the full enjoyment of such right.”

These restatements of already existing rights would be of little concern, but for the addition of this provision; “It is not a defense to liability pursuant to this chapter that a covered individual has qualified immunity or any other substantially equivalent immunity.” 

What exactly is qualified immunity, and why is its abolition as a defense a problem for law enforcement?

According to FBI Academy Instructor Richard Schott, quoting from the US Supreme Court case of Harlow v. Fitzgerald (457 U.S. 800 (1982)), “government officials performing discretionary functions generally are shielded from liability for civil damages insofar as their conduct does not violate clearly established statutory or constitutional rights of which a reasonable person would have known.”  

Justice Powell, writing for the majority, continued:

“[o]ur decisions have recognized immunity defenses of two kinds. For officials whose special functions or constitutional status requires complete protection from suit, we have recognized the defense of “absolute immunity.” The absolute immunity of legislators, in their legislative functions, and of judges, in their judicial functions, now is well settled. Our decisions also have extended absolute immunity to certain officials of the Executive Branch. These include prosecutors and similar officials, executive officers engaged in adjudicative functions, and the President of the United States. For executive officials in general, however, our cases make plain that qualified immunity represents the norm. [W]e [have] acknowledged that high officials require greater protection than those with less complex discretionary responsibilities.”

In language particularly relevant, Justice Powell stated that “public officers require this protection to shield them from undue interference with their duties and from potentially disabling threats of liability.”

(L)aw enforcement officers are government officials who perform discretionary functions and may be protected by qualified immunity. This shield of immunity is an objective test designed to protect all but ‘the plainly incompetent or those who knowingly violate the law’…officers are not liable for damages ‘as long as their actions reasonably could have been thought consistent with the rights they are alleged to have violated’…qualified immunity is not appropriate if a law enforcement officer violates a clearly established constitutional right.” 

According to Attorney Rebecca Pirius, “(j)udges created the qualified immunity shield as a way to balance the competing needs of (1) public officials to perform discretionary duties without the constant fear of being sued and (2) victims to hold public officials accountable for acting in violation of the law…Proponents of the current rule argue it’s needed so public officials can perform their duties without hesitation. And, because lawsuits won against public officials almost always end up being paid for by the government entity, the financial burden of loosening the standard would fall to local and state governments and taxpayers. Opponents argue that the ‘clearly established rights’ standard is so high that victims can only win if they can point to a case with nearly identical facts and circumstances. Given this high bar, critics maintain public officials are not accountable for their actions, and victims effectively have no remedy under the law for violations.”

There is no denying that in certain instances, the application of the qualified immunity doctrine has led to unfair results.  In the case of Dukes v. Deaton (852 F.3d 1035 (11th Cir. 2017)), an officer executing a “No-knock” search warrant, tossed a flash-bang grenade through the bedroom window of the residence to be searched, without looking to see whether anyone was present.  One of the two occupants of the bedroom was seriously burned by the grenade.

In dismissing the case, the 11th Circuit ruled that “(a)lthough we agree with Dukes that Deaton used excessive force, we also agree with the district court that Deaton is entitled to qualified immunity because it was not clearly established that his conduct violated the Constitution. And he is entitled to official immunity because Dukes offers no proof that Deaton intended to injure Dukes.” 

A case like this clearly points to the necessity of reforming the law of qualified immunity.  However, rather than look for an approach that would protect both Police Officers trying to do their jobs, and people whose rights have been violated, the New York City Council almost literally throws the baby out with the bathwater.  As described by Fox News, “(o)pponents of the bill said it might discourage some from getting into law enforcement. ‘Ending qualified immunity will prevent the best young men and women in our city from joining the police force,’ Councilman Robert F. Holden said as he voted no, according to the New York Times…’New Yorkers are getting shot, and police officers are on the streets day and night, trying to stop the bloodshed,’ Patrick Lynch, president of the Police Benevolent Association, said in a statement, adding that the new bill would ‘chill the operations of law enforcement.’” 

It would seem prudent and reasonable, that at a time of increased violent criminal activity, the City of New York would want their police force unfettered by worries of civil liability.  Instead, the City Council prefers its law enforcement officers to act with the threat of personal liability for their actions hanging over their every move.

In this environment, who would want to wear the once-proud uniform of the NYPD?

During a meeting in Washington with the Australian Foreign Minister, Secretary Blinken was asked about China. “Without equivocation, the PRC Government is among the worst abusers of religious freedom in the world. One of the other worst abusers is the Government of North Korea. There’s no question that these two governments stand, unfortunately, together in this hall of shame,” according to Daniel Nadel, a senior State Department official in the Office of International Religious Freedom. What is happening in western China goes beyond Nadel’s concern about eliminating religious freedom. Lives are at stake. President Xi Jinping intends to fundamentally alter the social and physical landscape of Xinjiang. The communist government has built hundreds of detention centers in the autonomous region. Minority women, including Uyghur, Kazakh, and other indigenous nationalities, are losing their reproductive rights. Whole families are placed indefinitely in detention centers.

Secrecy and disbelief helped enable the Germans in WWII to commit widespread atrocities. Today, the Chinese government is taking a page from Hitler’s notebook and committing genocide in northwestern China under a 21st century style cloak of secrecy suppressing social media accounts of the atrocities. The world, however, is not obeying China’s warnings. Adrian Zenz, of the Victims of Communism Memorial Foundation, said “we know it’s mass internment.” In June 2020, The Jamestown Foundation issued a report on the incarcerations and atrocities in the region, saying they met the UN criteria for classification as “genocide.” This week the Australian Strategic Policy Institute released an in-depth report describing Chinese efforts to reduce the size of the indigenous population in Xinjiang, saying that Beijing is calling for a decrease in the birth-rate in southern Xinjiang by at least 4.00 per thousand from 2016 levels.

Together with the other abuses and detention camps, which can be seen by satellite, China is facing increased scrutiny for its genocidal policies toward its minorities. Now is not the time for the world to cower to China’s demands that we look the other way.

Despite the growing danger, there appears to be little reaction in Washington.  Although the U.S. is withdrawing from Afghanistan, the effect of decades of concentrating on countering terrorism has exhausted U.S. personnel and depleted combat equipment. We intercepted over 60 aircraft last year. … We monitor more than that,” Lt. Gen. David Krumm said from Joint Base Elmendorf-Richardson. “That’s the most action the Alaska Air Defense Identification Zone — a region spanning 200 nautical miles that reaches past U.S. territory and into international airspace — has seen since the Soviet Union fell in 1991.”

Open Letter from Retired Generals and Admirals

Our Nation is in deep peril. We are in a fight for our survival as a Constitutional Republic like no other time since our founding in 1776. The conflict is between supporters of Socialism and Marxism vs. supporters of Constitutional freedom and liberty. 

During the 2020 election an “Open Letter from Senior Military Leaders” was signed by 317 retired Generals and Admirals and, it said the 2020 election could be the most important election since our country was founded. “With the Democrat Party welcoming Socialists and Marxists, our historic way of life is at stake.” Unfortunately, that statement’s truth was quickly revealed, beginning with the election process itself. 

Without fair and honest elections that accurately reflect the “will of the people” our Constitutional Republic is lost. Election integrity demands insuring there is one legal vote cast and counted per citizen. Legal votes are identified by State Legislature’s approved controls using government IDs, verified signatures, etc. Today, many are calling such commonsense controls “racist” in an attempt to avoid having fair and honest elections. Using racial terms to suppress proof of eligibility is itself a tyrannical intimidation tactic. Additionally, the “Rule of Law” must be enforced in our election processes to ensure integrity. The FBI and Supreme Court must act swiftly when election irregularities are surfaced and not ignore them as was done in 2020. Finally, H.R.1 & S.1, (if passed), would destroy election fairness and allow Democrats to forever remain in power violating our Constitution and ending our Representative Republic. 

Aside from the election, the Current Administration has launched a full-blown assault on our Constitutional rights in a dictatorial manner, bypassing the Congress, with more than 50 Executive Orders quickly signed, many reversing the previous Administration’s effective policies and regulations. Moreover, population control actions such as excessive lockdowns, school and business closures, and most alarming, censorship of written and verbal expression are all direct assaults on our fundamental Rights. We must support and hold accountable politicians who will act to counter Socialism, Marxism and Progressivism, support our Constitutional Republic, and insist on fiscally responsible governing while focusing on all Americans, especially the middle class, not special interest or extremist groups which are used to divide us into warring factions. 

Additional National Security Issues and Actions: 

• Open borders jeopardize national security by increasing human trafficking, drug cartels, terrorists entry, health/CV19 dangers, and humanitarian crises. Illegals are flooding our Country bringing high economic costs, crime, lowering wages, and illegal voting in some states. We must reestablish border controls and continue building the wall while supporting our dedicated border control personnel. Sovereign nations must have controlled borders.

• China is the greatest external threat to America. Establishing cooperative relations with the Chinese Communist Party emboldens them to continue progress toward world domination, militarily, economically, politically and technologically. We must impose more sanctions and restrictions to impede their world domination goal and protect America’s interests. 

• The free flow of information is critical to the security of our Republic, as illustrated by freedom of speech and the press being in the 1st Amendment of our Constitution. Censoring speech and expression, distorting speech, spreading disinformation by government officials, private entities, and the media is a method to suppress the free flow of information, a tyrannical technique used in closed societies. We must counter this on all fronts beginning with removing Section 230 protection from big tech. 

• Re-engaging in the flawed Iran Nuclear Deal would result in Iran acquiring nuclear weapons along with the means to deliver them, thereby upsetting Mideast peace initiatives and aiding a terrorist nation whose slogans and goals include “death to America” and “death to Israel” . We must resist the new China/Iran agreement and not support the Iran Nuclear Deal. In addition, continue with the Mideast peace initiatives, the “Abraham Accords,” and support for Israel. 

• Stopping the Keystone Pipeline eliminates our recently established energy independence and causes us to be energy dependent on nations not friendly to us, while eliminating valuable US jobs. We must open the Keystone Pipeline and regain our energy independence for national security and economic reasons. 

• Using the U.S. military as political pawns with thousands of troops deployed around the U.S. Capitol Building, patrolling fences guarding against a non-existent threat, along with forcing Politically Correct policies like the divisive critical race theory into the military at the expense of the War Fighting Mission, seriously degrades readiness to fight and win our Nation’s wars, creating a major national security issue. We must support our Military and Vets; focus on war fighting, eliminate the corrosive infusion of Political Correctness into our military which damages morale and war fighting cohesion. 

• The “Rule of Law” is fundamental to our Republic and security. Anarchy as seen in certain cities cannot be tolerated. We must support our law enforcement personnel and insist that DAs, our courts, and the DOJ enforce the law equally, fairly, and consistently toward all. 

• The mental and physical condition of the Commander in Chief cannot be ignored. He must be able to quickly make accurate national security decisions involving life and limb anywhere, day or night. Recent Democrat leadership’s inquiries about nuclear code procedures sends a dangerous national security signal to nuclear armed adversaries, raising the question about who is in charge. We must always have an unquestionable chain of command. 

Under a Democrat Congress and the Current Administration, our Country has taken a hard left turn toward Socialism and a Marxist form of tyrannical government which must be countered now by electing congressional and presidential candidates who will always act to defend our Constitutional Republic. The survival of our Nation and its cherished freedoms, liberty, and historic values are at stake.

We urge all citizens to get involved now at the local, state and/or national level to elect political representatives who will act to Save America, our Constitutional Republic, and hold those currently in office accountable. The “will of the people” must be heard and followed.

The Peculiar Ethics of Modern Society

The avoidance of western moral standards has led to peculiar ethical choices.

Much of this is seen through the prism of progressive politics and “woke” concepts that have, as its guiding principle, a rejection of values seen as emblematic of modern American society.

There is increasing pressure to teach the youngest students issues of gender and sex practices. However, many of the same educational bureaucrats who advocate this shrink in horror at even innocuous discussions of the most basic concepts of religion or morality. Teachers who mention fellatio face far less scrutiny than those who dare say “Merry Christmas” or “Happy Channukah.”

The concept of not tilting towards one religious creed over the other has been replaced by a strenuous avoidance of all western faith practices.

There is a level of hypocrisy that is almost overwhelming.

Entire branches of the U.S. federal government will vigorously assault anyone who engages in land development actions that may endanger an obscure animal species. Germany scrupulously rejects its terrible history of antisemitism, but nevertheless has extensive trade relations with Iran, a nation ruled by a regime that vocally promises to exterminate the Jewish nation.

The recent decision by MLB to remove its All-Star Game from a minority-majority city to a far more Caucasian venue, based on a highly politicized and intentional misinterpretation of a new state law, highlights the growing rejection of actual morality in favor of virtue signaling. Indeed, the jurisdiction the game is being moved to has similar laws to that which has been abandoned.

The very concept of western morality, based on Judeo-Christian ethics is shunned, despite the extraordinary advances it has brought about in human dignity and freedom. There are far too many who erroneously equate support for traditional values with the forced imposition of them on the unwilling.

The very western concept of the wonderful and supreme value of each human soul is not part of the progressive mantra, which far prefers the collectivist view that we are all just cogs in a wheel in which ethics are situational based on the needs of a larger society.

To make matters worse, California Congresswoman Maxine Waters came to Minneapolis and injected herself into the case.  Appearing before a crowd prior to the jury’s commencement of deliberations, “Waters told the crowd Saturday night that she wanted to see a murder conviction against Chauvin for Floyd’s death.  When asked what should happen if Chauvin wasn’t convicted on murder charges, she replied, ‘We got to stay on the street, we’ve got to get more active, we’ve got to get more confrontational.’” 

The inevitable defense motion for a mistrial was predictably denied by Judge Cahill.  However, the Court made some very important remarks that may be very relevant to the eventual appeal of Chauvin’s conviction; “I’ll give you that Congresswoman Waters may have given you something on appeal that may result in this whole trial being overturned.”  Cahill also added that “I wish elected officials would stop talking about this case, especially in a manner that is disrespectful to the rule of law and to the judicial branch and our function…I think if they want to give their opinions, they should do so in a respectful and in a manner that is consistent with their oath to the Constitution, to respect a coequal branch of government.” 

Even President Biden couldn’t resist expressing his views on the Chauvin case;  “I’m praying the verdict is the right verdict, which is — I think it’s overwhelming, in my view.” 

With this level of pre-trial publicity and violence, with the threat of more violence hanging in the air, observing the extreme security measures, hearing the large settlement paid to the family of the deceased prior to trial, and hearing a Congresswoman publicly call for more unrest if the defendant is not found guilty, what else could the jury do but find Chauvin guilty of all charges?

Recently, its been learned that at least one juror was predisposed to find Chauvin guilty.  Brandon Mitchell, juror number 52, has been making the rounds of public appearances since the verdict.  during one interview, Mitchell “advocated using jury duty for social justice purposes.”  More significant, Mitchell may have been untruthful during jury selection.

“’Judge Cahill asked Juror #52, whether he heard anything about the #GeorgeFloyd civil case,’ KMSP reporter Paul Blume tweeted on March 15.  ‘He says, no. He explained hearing some basic info about trial dates, etc from the news in recent months, but nothing that would keep him from serving as impartial juror,’ Blume posted… But once the trial was over and Chauvin had been convicted on all three charges, it turned out that Mitchell had engaged in activism.  Pictures posted to social media by a family member showed that Mitchell had actively participated in anti-police protests in Washington, DC last summer while wearing a Black Lives Matter t-shirt that said ‘Get Your Knee Off Our Necks.’  His uncle, Travis Mitchell, posted the picture to Facebook on Aug. 31, 2020,’ a full 7 months prior to Mitchell’s selection as a juror. 

Mitchell wore the t-shirt at a rally in Washington to commemorate Martin Luther King’s “I Have a Dream” speech.    While, as he states, his presence at the rally may not have had anything to do with his jury service, the phrase “get your knee off our necks,” is clearly a reference to George Floyd, and demonstrates Mitchell had more knowledge about the case than he admitted to Judge Cahill.

It’s possible that one or two of these circumstances might not be enough to lead a reasonable person to believe Derek Chauvin’s trial was unfair.  But given all of these factors, it is obvious that the jury that heard this case could not have been anything but intimidated, and even biased, by this combination of influences.

Did Derek Chauvin Receive A Fair Trial?

Judge John Wilson analyzes the controversial trial of Derek Chauvin. Throughout American history, the right to a fair trial has always been held sacrosanct, no matter how heinous the crime or how outraged the public may be. Was that concept violated in this case?

On April 20, 2021, a Minneapolis jury found Police Officer Derek Chauvin guilty of murdering George Floyd.  Not since the OJ Simpson verdict in 1995 has a jury’s decision been more anticipated by our nation.  Or more divisive.   

Officer Chauvin was charged with, and ultimately found guilty of, three separate counts under Minnesota state law; 

Section 609.19, Murder in the Second Degree, which reads at Subdivision 2, ” Unintentional murders.  Whoever does either of the following is guilty of unintentional murder in the second degree and may be sentenced to imprisonment for not more than 40 years:  (1) causes the death of a human being, without intent to effect the death of any person, while committing or attempting to commit a felony offense…”

Section 609.195, Murder in the Third Degree, which states at subsection (a) “Whoever, without intent to effect the death of any person, causes the death of another by perpetrating an act eminently dangerous to others and evincing a depraved mind, without regard for human life, is guilty of murder in the third degree and may be sentenced to imprisonment for not more than 25 years.” and

Section 609.205, Manslaughter in the Second Degree, which states at subdivision 1 that a person is guilty of this charge when “by the person’s culpable negligence whereby the person creates an unreasonable risk, and consciously takes chances of causing death or great bodily harm to another.”  

Was the jury correct?  Is Officer Chauvin actually guilty of the charges for which he was convicted?

Almost everyone in the world has seen the video of George Floyd’s arrest, and the actions of Officer Chauvin.  The jury had the opportunity to view that same video, to hear the witnesses, medical examiners, and whatever other evidence that was presented by both the prosecution and the defense.  After doing so, they discharged their duty, and rendered a verdict.

But was that verdict based upon the evidence presented alone?  Or were there other factors present which impacted the jury’s ability to remain fair and impartial?

Almost to a certainty, the answer is obvious – Derek Chauvin did not get a fair trial by an impartial jury.

During Jury selection, the City of Minneapolis settled a wrongful death lawsuit brought by the family of George Floyd for $27 million dollars.  As noted by the Associated Press, “Ted Sampsell-Jones, a criminal law expert at the Mitchell Hamline School of Law, said it’s additional pretrial publicity that is ‘bad for the defense’ and could lead some jurors to think guilt has already been decided.'”  Yet, the trial judge, Peter Cahill, refused a defense motion to either delay the trial, or more importantly, to change the venue of the trial from Minneapolis.   

The record-breaking payout, which is still being finalized, led Cahill to re-interview several jurors and dismiss two after Chauvin’s attorney Eric Nelson…argued that news of the settlement could prejudice the mostly seated jury…(Cahill said that) while he was surprised to see the impact of the settlement on jurors, he still didn’t think time or distance would improve the fairness of the trial. ‘Unfortunately, I think the pretrial publicity in this case will continue no matter how long we continue it,’ he said. ‘And as far as change of venue, I do not think that would give the defendant any kind of a fair trial beyond what we are doing here today. I don’t think there is any place in the state of Minnesota that has not been subjected to extreme amounts of publicity on this case.’” 

Under this cloud, jury selection continued, and the trial commenced.  

As reported by the Associated Press, “More than 3,000 National Guard soldiers, along with police officers, state police, sheriffs deputies and other law enforcement personnel have flooded (Minneapolis) in recent days, with a verdict looming in the trial of Derek Chauvin… Concrete barriers, chain-link fences and barbed wire now ring parts of downtown Minneapolis so that authorities can quickly close off the courthouse where the trial is being held. It’s become normal in recent days to pass convoys of desert-tan military vehicles on nearby highways, and stumble across armed men and women standing guard… Meanwhile hundreds, and perhaps thousands, of stores and other buildings have been boarded up across the city…behind all the security are the days of violence that began with protests over Floyd’s death…City officials estimate the city suffered roughly $350 million in damage, mostly to commercial properties.” 

One tool the Court can use to insure a fair trial is to sequester a jury; that is, keep them separated from the general public from their selection until the end of the trial.  The Chauvin’s defense attorney asked for the sequestration of the jury before the trial started, but that motion was denied by the court.  During the trial, “(a)fter a fatal police shooting near Minneapolis…former Minneapolis police officer Derek Chauvin’s attorney expressed concern that jurors in his murder trial could be swayed by the events… Defense attorney Eric Nelson asked that jurors be questioned on what they had heard about the police shooting of 20-year-old Daunte Wright in Brooklyn Center, a nearby city in Hennepin County. Unrest followed the shooting: Police deployed tear gas and flash-bang grenades to clear protesters who had gathered outside the Brooklyn Center Police Department.  One of the jurors lives in Brooklyn Center, and others have ties to the city, Nelson said. He said jurors should have already been sequestered due to the high-profile nature of the case and its tendency to evoke strong emotions… Nelson also expressed concern that jurors might be made nervous to deliver a verdict with which the public does not agree.”  Once more, the motion to sequester the jury was denied.
