Monumental changes do not always occur with fanfare and explosive action.  Sometimes, they occur gradually, as a result of actions that seemed relatively inconsequential at first but developed into extraordinary alterations in the very fabric of society.

That is currently occurring in the United States.  Since the 1960s, radical takeovers of the fields of education, journalism and entertainment by individuals and groups who have a profoundly different view of America than the majority, has had an undeniable impact.

At least two generations of U.S. students have been taught by educators who have an exceptionally negative view of the nation.  Journalism, both traditional and online, has morphed from a profession that sought to objectively inform the public to one that preaches a left-wing party line to it.  Hollywood has followed that move, as well. 

The result is a nation profoundly divided and substantially divorced from accuracy in its news reporting and educational system, a society that has forgotten how it achieved unprecedented success and established the most open society in history. The left will point out the horrors of slavery and segregation, but ignores the reality that those original sins, shared with the rest of the world, have been overcome.

All this has resulted in the rise to power and influence of politicians and pundits who would alter America’s successful path to one that resembles nations that have failed politically and economically.

The intensity of this underreported change is stunning. With all the power at its command, the media has hidden truths about the dangerous path the nation is taking, and those who are making that happen,  Examples:

Erwin Chemerinsky cheers on the discredited idea of “court packing” in the Los Angeles Times; “One way for Democrats to make clear they will not tolerate Republicans trying to fill this seat in advance of the election would be for them to pledge that, if they take the White House and Senate in November, they will increase the size of the Supreme Court to 13 justices.” 

Since 1869, the United States Supreme Court has consisted of 9 judges.  “Congress can shape the size of the Court to its political desires. In 1866, with a Congress at permanent war with President Andrew Johnson, it passed the Judicial Circuits Act, which cut the size of the court from nine to seven, and barred Johnson from appointing any new Justices. (After Ulysses Grant was elected President in 1868, the number was bumped back up to nine, where it has remained ever since.)” 

“The most famous example was the effort by President Franklin Roosevelt in 1937 to deal with a Court that was striking down much of his New Deal legislation. After his landslide re-election in 1936, he proposed to add one justice for every judge who’d reached the age of 70, up to a total of 15…(d)espite his popularity, and the overwhelming control of the Congress by Democrats, the proposal became the first political defeat of FDR’s presidency—and came at the hands of his own party. His own vice-president, John Garner, fought it. The Democratic leader in the Senate rejected it….(t)he proposal died in Congress before a vote was taken.” 

Unfortunately, unlike FDR, a President Biden would not be opposed by a Vice President Harris in anything, least of all a scheme to pack the Supreme Court with new progressive judges, nominated to counterbalance the conservatives who would be in the majority were Trump’s nominee to be approved by Congress.  This leftist dream scenario is entirely possible.

In response, Congressman Doug Collins (R-Ga) has plans to introduce “a constitutional amendment to prohibit a change to the size to the Supreme Court until 10 years after enactment of any legislation that would alter the number of seats on the high court.”  However, as noted by Fox News, “(t)here’s a high bar to passing an amendment: In order to pass, a constitutional amendment must receive approval from two-thirds of the House and Senate, as well as ratification from three-fourths of all states, or 38 out of 50.”

All politics is cyclical.  Today we have a Republican President – more likely than not, that President will be followed by a Democrat, who will then be followed by a Republican.  Jimmy Carter, a Democrat, was followed by Ronald Reagan.  After George HW Bush (who, it has been argued, was an extension of the Reagan presidency) came Bill Clinton, another Democrat, who was followed by George W. Bush.  After Bush came Barak Obama, who has been followed by Donald Trump.

During Obama’s presidency, “Senate Democrats — then in the majority — triggered the nuclear option for the first time…Democrats led by Senate Majority Leader Harry Reid of Nevada, changed the rules so that lower court and Cabinet nominees could be confirmed with a simple majority, rather than the typical 60-vote threshold.” 

At the time, Democrats believed they could rely upon a “permanent majority” – a nonsensical notion, but one that lead the then-Democratic majority to make a rules change that has been used against them repeatedly during the Trump Administration.  “(T)he total number of (federal) judges confirmed under (the Trump) administration (is) 216, which represents nearly one-fourth of all active (federal) judgeships.” 

All of these judges have been approved by simple majority vote.

Thus, were a Democratic Administration to “pack” the Court in 2021, in 2032, a Republican Administration could easily either appoint more Supreme Court judges, or scale back the number then-sitting.  Significant damage will have been done, no doubt.  But the cyclical nature of our system will endure.

Whether you are on the left or the right, the passing of Supreme Court Justice Ruth Bader Ginsberg is a historic event.  For the left, Justice Ginsberg was an admirable figure, and a pioneering feminist.  For those on the right, “Justice Ginsburg’s using her position to try to impose a feminist vision on federal policy ought to be recognized for what it was: an abuse of power. If you want to rewrite the law along feminist lines, that’s a perfectly honorable project — run for Congress.” 

In fact, the death of Justice Ginsberg has exposed yet another fault line in American political thought.  For the left, a judge should be an activist – that is, “(t)he courts should stand in the way of democratic majorities, in order to keep majority rule from degenerating into majority tyranny.”    Meanwhile, conservatives believe that “the role of judges is to enforce the Constitution and laws that conform to the Constitution . . . to give effect to the words of the Constitution and statutes. If the meaning of the words is clear, the judge goes no further.” 

In other words, one side wants judges to defer to the will of the legislature, who are the duly elected representatives of the people, and interpret laws as they are written.  the other wants judges to temper and “reinterpret” the acts of the legislature.  However, in “tempering” the acts of any legislative branch, an activist judge ends up substituting their own views for those of the elected officials who made those laws.  Herein lies the real problem of activist judges –  “they seek to impose their personal preferences. But a judge who looks beyond the text of the Constitution ‘looks inside himself and nowhere else.’” 

President Trump has made it a point to nominate judges to both the lower federal courts and the Supreme Court who are strict constructionists – “all of whom will faithfully uphold our Constitution as written,” in the President’s own words.  Keeping this promise is exactly what the left fears.

Without a doubt, the person named to replace Justice Ginsberg will not be an activist in any way.  Another legally conservative judge will tilt the balance of the high court in favor of strict construction of the law, or as Ian Millhiser frets in  in Vox, “(l)ong after Trump leaves office, these judges will shape American law — pushing it further and further to the right even if the voters soundly reject Trumpism in 2020.”

Despite a Biden victory and a newly Democratic Senate, the lame-duck Republicans have confirmed a young, conservative justice and locked in a powerful and durable 6-3 majority on the nation’s highest court… (w)ithin days, or moments, of the start of new Senate session, Majority Leader Chuck Schumer announces his intention to move legislation that would expand the Supreme Court from nine to 13 members, to ‘repair the wound inflicted on our Constitution by the Republicans’ refusal to recognize the will of the electorate.’ The Senate and House pass the bill, and President Joe Biden signs it on Inauguration Day.”

The Chinese Communist Party (CCP) and its proxies aim to make Americans receptive to Beijing’s form of authoritarianism, according to Secretary of State Michael Pompeo. In a Thursday interview he said the CCP “is hard at work at the state level.” Pompeo pointed out that they have rated every government essentially a friend, foe or somewhere in between. They also are evaluating whether American governors are working in ways that benefit them, he said. In the United States the CCP works actively to develop relationships with state elected officials. When the Secretary was in Wisconsin on Wednesday, he talked about China’s using their “United Front development programs to undermine our democracy and to move the direction of opinion in the direction of their authoritarian regime.” Washington is working to actively push back on aggressive moves conducted by China inside the US.

President Obama and Vice President Biden entered into a bad nuclear deal in Iran. Pompeo said it was “just crazy,” as it presented a clear pathway to a nuclear weapon, and that this was unacceptable for the security of the Middle East, Israel, and the United States.

Biden Corruption Revealed

Hunter Biden has reportedly engaged in serious levels of influence peddling, financial ties to corrupt government officials, and deals with the Chinese military. He has also associated with human traffickers. The New York Analysis of Policy and Government presents a summary of the report provided by the Senate Homeland Security and Governmental Affairs Committee, and the Senate Finance Committee.

U.S. Senators Ron Johnson (R-Wis.), chairman of the Senate Homeland Security and Governmental Affairs Committee, and Chuck Grassley (R-Iowa), chairman of the Senate Finance Committee, released a report that revealed millions of dollars in questionable financial transactions between Hunter Biden and his associates and foreign individuals, including the wife of the former mayor of Moscow and individuals with ties to the Chinese Communist Party.

These were just some of the findings from their investigation into potential conflicts of interest arising from Hunter Biden accepting a position on the board of, and taking millions of dollars from, Burisma, a Ukrainian energy company with a long-standing reputation for corruption, while his father, Joe Biden, was vice president and the public face of the Obama administration’s handling of Ukraine policy. 

Findings from the chairmen’s investigation include:

  • In early 2015 former Deputy Chief of Mission at the U.S. Embassy in Kyiv, Ukraine, George Kent raised concerns to officials in Vice President Joe Biden’s office about the perception of a conflict of interest with respect to Hunter Biden’s role on Burisma’s board.  Kent’s concerns went unaddressed and in September 2016, he emphasized in an email to his colleagues, “Furthermore, the presence of Hunter Biden on the Burisma board was very awkward for all U.S. officials pushing an anticorruption agenda in Ukraine.”
  • In October 2015, senior State Department official Amos Hochstein raised concerns with Vice President Biden, as well as with Hunter Biden, that Hunter Biden’s position on Burisma’s board enabled Russian disinformation efforts and risked undermining U.S. policy in Ukraine.
  • Hunter Biden was serving on Burisma’s board (supposedly consulting on corporate governance and transparency) when Burisma owner Mykola Zlochevsky allegedly paid a $7 million bribe to officials serving under Ukraine’s prosecutor general, Vitaly Yarema, to “shut the case against Zlochevsky.” George Kent testified that this bribe occurred in December 2014 (seven months after Hunter Biden joined Burisma’s board), and, after learning about it, he and the resident legal adviser reported this allegation to the FBI.
  • In addition to the over four million dollars paid by Burisma to Hunter Biden and his business partner, Devon Archer, for membership on the board, Hunter, his family, and Archer received millions of dollars from foreign nationals with questionable backgrounds.
  • Devon Archer received $142,300 from Kenges Rakishev of Kazakhstan, purportedly for a car, the same day Vice President Joe Biden appeared with Ukrainian Prime Minister Arsemy Yasenyuk and addressed Ukrainian legislators in Kyiv regarding Russia’s actions in Crimea.
  • Hunter Biden received a $3.5 million wire transfer from Elena Baturina. Ms. Baturina is the wife (widow) of the former mayor of Moscow.
  • Hunter Biden had business associations with Ye Jianming, Gongwen Dong, and other Chinese nationals linked to the Communist government and People’s Liberation Army. Those associations resulted in millions of dollars in questionable transactions. 
  • Hunter Biden opened a bank account with Gongwen Dong that financed a $100,000 global spending spree with James Biden and Sara Biden.
  • Hunter Biden also moved millions of dollars from his law firm to James Biden’s and Sara Biden’s firm.  Upon being questioned about the transaction, Sara Biden refused to provide supporting documentation and information to more clearly explain the activity. The bank subsequently closed the account.
  • Hunter Biden paid nonresident women who were nationals of Russia or other Eastern European countries and who appear to be linked to an “Eastern European prostitution or human trafficking ring.”

The New Low-Yield Nuclear Arms Race

The socialist economy of the Soviet Union made its vast military establishment unaffordable. The successor to that nation, the Russian Federation, continues to struggle with its own brand of incompetence and corruption, making conventional military forces unaffordable.

However, that has not stopped Moscow from pursuing its goal of restoring the Soviet Empire.  It does so by relying on nuclear weapons.  Thanks to treaties agreed to by Barack Obama and Hillary Clinton, it has become the world’s strongest atomic force.

Part of Putin’s move to reassert his nation as an influential power is the use of nuclear armaments to replace conventional forces, including so-called “battlefield” nukes.

According to a U.S. government report, the Russian Federation has adopted a policy to use nuclear weapons not just in in response to the use of nuclear or other weapons of mass destruction against it or its allies, but also in response to whatever it perceives to be a significant threat.

The report notes that Russian has developed “precision low-yield” nuclear weapons for strikes “anywhere in the world.”  By the cvlose of the 20th Century, Moscow developed atomic weapons with  reported yields “from several tens of tons to 100 tons of TNT equivalent.” Russia is also developing “superlow-yield weapons” and “penetrators, ” along with “‘clean’ nuclear weapons.”

The “de-escalation” doctrine, Putin’s references to nuclear weapons in his public statements and the broad modernization of Russia’s nonstrategic nuclear forces suggest that the classified strategy could envisage use of those weapons in wider circumstances.

In response, U.S. Defense Policy Undersecretary John Rood has announced that the U.S. Navy has fielded the W76-2 low-yield submarine-launched ballistic missile (SLBM) warhead. The Defense Department has identified the requirement to “modify a small number of submarine-launched ballistic missile warheads” to address the danger from potential adversaries, like Russia, who believe that employment of low-yield nuclear weapons will give them an advantage over the United States and its allies and partners.

Rep. Mac Thornberry (R-TX), ranking member of the House Armed Services Committee, notes that “The greatest national security imperative is to deter any adversary from using a nuclear weapon in any circumstance. This deployment enhances U.S. deterrence and tells Russia that any attempt to use nuclear weapons as part of an ‘escalate to deescalate’ approach will not be successful. This action, which was called for in the latest Nuclear Posture Review and was also recommended by President Obama’s Defense Science Board, is a needed, prudent step to strengthen the security of the U.S. and our allies.”

Supreme Over-Reaction

The response to the vacancy created by the death of Justice Ruth Bader Ginsberg has been, to say the least, over the top.

To be clear, whether it is an election year or not, the President has the absolute, constitutional right to nominate a candidate to fill the vacancy.  The Appointments Clause, found in the Constitution’s Article II, Section 2, clause states that the President “shall nominate, and by and with the Advice and Consent of the Senate, shall appoint … Judges of the Supreme Court.” There is no prohibition on doing so in an election year. The Senate has the right to accept or decline the candidate. Both parties have played the game of trying to either rush to the finish line or wait out the clock, depending on whether they control the White House or not.

In 2016, when the tables were reversed and Obama was in the Oval Office, Joe Biden said that it was the “constitutional duty” of the president to fill the vacancy, even in an election year. He has reversed himself. The Republicans have also taken the opposite position this year.

Normally, one would call this politics as usual, except for the extreme and verbally violent nature of the Democrat response to the White House announcement of its intention to engage in the process before the election. It brings up the uncomfortable reality that the current crop of Democrat Party leaders are more than willing to burn down the Republic in their bid to gain power.

“Squad” leader Rep. Alexandria Ocasio-Cortez (D-NY) said the President was “Playing with fire” if he proceeds with a nomination, and openly implied that violence in the streets was an appropriate response. Nancy Pelosi, in complete defiance of the Constitution, threatens to impeach Trump—again!—for merely doing his constitutional duty. Senate Minority Leader Charles Schumer, (D-NY) who famously introduced legislation to weaken the First Amendment, warns that if his party regains control, it will “pack the court” with justices exceeding the tradition-honored number of nine, in an effort to ensure that justices with his point of view gain the majority.  Demonstrators have gone to the home of Senate Majority Leader Mitch McConnell (R-Kentucky) in an effort to intimidate him.

These inappropriate moves must be seen in combination with other wholly unacceptable acts and comments that have unfolded during this election season.  Former Secretary of State John Kerry, the architect of the Obama Administrations’ still unexplained tilt away from traditional American allies in the Mideast and towards the terrorist-sponsoring nation of Iran, has said that “all bets are off” if Trump wins.  Hillary Clinton has urged Biden to “never concede under any circumstances” the election.

In several states, Democrats have pushed the notion that signatures need not be verified on mail in ballots, an open invitation to fraud.

None of these inflammatory statements and actions can be seen as business as usual.  They are a profound and extreme break from the time-honored American tradition of a peaceful transition of power, which has kept the nation intact since its founding, except, of course, for when, in an effort to preserve slavery, Democrats split from the Union and commenced the Civil War.  

Politics is certainly a rough endeavor, and tempers can and will flair. But not since the Civil War has the rhetoric been so violent, and, frankly, so wrong. The nation could never have lasted for so long had the willingness to put party ahead of country, clearly demonstrated by the use of outrageous rhetoric and the condoning of violence in the streets by leading leftist and progressive politicians, been utilized as it is currently.

Rebellion

The hideous disorder in cities like New York, Chicago, Portland, Seattle, and even Washington D.C. are neither protests nor riots.  They are not mere acts of crime, either. Indeed, the assault on the federal courthouse in Portland was the moral equivalent of the attack on Fort Sumter that commenced the Civil War.

It is time to properly identify what is going on in these great urban centers: rebellion against the Constitution. Assaulting innocents for merely wearing MAGA hats, Invading police stations, declaring whole neighborhoods to be “autonomous zones,” burning buildings, assaults on law enforcement personnel, and engaging in mass lootings have nothing to do with any particular issue or racial division.  They are, in fact, acts of secession. 

A secession that, similar to what happened in 1861, has been aided and abetted by some Democrat leaders. As Washington urgently sought to restore safety in Portland, House Speaker Nancy Pelosi called federal law enforcement personnel “stormtroopers,” tweeting “@DHSgov’s actions in Portland undermine its mission. Trump & his stormtroopers must be stopped.”  A friendly media failed to ask the salient question, stopped from doing what? Preventing the destruction of a federal courthouse?

If these were merely the acts of a mob inflamed by recent news reports of particular incidents, the descriptions of rebellion or secession would not apply.  But the reality is that in most cases where the recent incidents of urban chaos have occurred, they have been tolerated or even inspired by hard-left elected officials.  Take just one example.  New York’s Mayor Bill de Blasio cheered on the Soviet Union when it placed combat forces in Nicaragua. As Mayor, he has spoken up against property rights and America’s capitalist system.

In Chicago, Mayor Lightfoot, in the aftermath of a weekend in which 24 people were killed, issued a firm statement—against potential victims defending themselves with guns. Similarly, A prosecutor in St. Louis seeks indict two people for engaging in legitimate self-defense. Portland’s mayor stands by while Antifa attacks journalists. 

The concepts of defunding the police, limiting First and Second Amendment rights, protests against reasonable measures by the federal government to protect U.S. borders at home and insure an adequate defense against increasingly powerful enemies abroad can only be seen, in the composite, as an attempt to bring down the lawfully elected government of the nation.

It’s a strategy that has been pursued with dedication since the election of 2016. Decades-long indoctrination by anti-capitalist, anti-Constitution educators, in some cases funded and incited in part by Beijing’s “donations” primed a generation to hate the nation that has provided more prosperity and more freedom than any in history. Misinformation delivered by a news media that has become little more than a mouthpiece for Progressive politicians brings that drive to a wider audience. Hollywood, now significantly invested with Chinese cash, obediently touts Beijing’s propaganda.  Finally, corporations and sporting leagues, who believe that kowtowing to China will bring them extraordinary riches, round-out the falsehoods that support the rebellion.

The substantial involvement of foreign influence in the Anti-Constitution Rebellion of 2020 makes it every bit as real and as dangerous as the Secession of 1861.

CHINA/TAIWAN

US undersecretary of State Keith Krach is on a three-day visit to Taiwan to  attend a memorial service for late president Lee Teng-hui. Japan, the 2nd largest economy in the Pacific and a long-term western ally, is “under consideration” according to British Prime Minister Boris Johnson. The US entered into the secret treaty establishing the group after World War II. It serves as a mechanism to share intelligence with each other in a secure environment and was one of the most significant documents of the Cold War era.

COLOMBIA

Columbia, once a staunch ally of the United States, is collaborating with China in return for financial and engineering assistance in building a subway system in Bogota and a 5G network for the country.
