Baseball’s Failed Experiment

 America’s long tradition as “The Land of Opportunity” is being replaced by the new philosophy of “equal outcomes,” regardless of the effort put in. The attempt to implement this idea, akin to the growing popularity of socialism, has already found a home in one of the nation’s most beloved institutions: Major League Baseball (MLB).

The results have not been good. 

MLB’s luxury tax and revenue sharing practices are also known as a “competitive balance tax.” Proponents of the concept allege that it was necessary to allow teams in smaller cities to play more competitively against big-city teams.  Hal Steinbrenner, a co-owner of one of those big-city teams, The New York Yankees, disagrees with the idea.  The National Review quotes him as stating “At some point, if you don’t want to worry about teams in minor markets, don’t put teams in minor markets, or don’t leave teams in minor markets if they’re truly minor…Socialism, communism, whatever you want to call it, is never the answer.”

Whatever label is placed on the concept, it has not achieved the results it was supposed to, and has in fact produced a whole new set of problems.

William Ryan Colby, in a paper presented to the e Department of Economics at Amherst College noted that “In 1996, Major League Baseball introduced its first system of comprehensive revenue sharing with the goal of creating more competitive balance in the league. the marginal tax rates created by MLB’s revenue sharing systems have actually worsened balance in the league. Although the most recent sharing system begins to realign incentives, it still risks “turning a ‘good’ imbalance into a ‘bad one” by subsidizing poorly managed teams at the expense of well run teams… the incentive structures created by MLB revenue sharing had the anticipated negative effects on competitive balance.

How the system has worked in practice is described by NBC sports “MLB teams participate in revenue sharing, a system that redistributes income from the richest franchises to their less profitable partners in an attempt to improve competitive balance. Under the 2012–2016 Collective Bargaining Agreement (CBA), each team contributes 34 percent of its net local revenue into a pool that gets divided equally among every team. Higher-earning clubs put in more than they get back while lower-earning clubs receive more than they put in…Over the past four years the Marlins, Rays, Royals, Padres and A’s among other teams received a combined $642 million dollars. The franchises that keep on giving to them are the New York Yankees, Boston Red Sox, Chicago Cubs, Philadelphia Phillies and San Francisco Giants. The mountain of cash deposited since 2012 i[reached] a staggering $1.15 billion [by 2016]”

There have been complaints that the organization that have received the revenue sharing have pocketed the money rather than invest in building more competitive teams. Indeed, it appears that some small market teams apparently no longer worry about trying to effectively compete, because even if attendance falls off due to poor play, revenue will still flow to them from revenue sharing.

According to some, that diminished devotion to meaningful competition means that teams, both in large markets and small, feel free to be less generous with player salaries.  

A 2018 CBS Sports report reported that “According to the Associated Press, the average MLB salary decreased from 2017-18. It’s only the fourth time in the last half-century the average salary decreased from one year to the next…The [MLB Players Association (MLBPA)] said…its final [2018] average was $4,095,686, down $1,436 from $4,097,122 last year. Since the union started keeping track in 1967, the only previous declines had been by $66 in 1987, when owners were found to have conspired to hold down salaries among free agents; a 4 percent decline in 1995 following a 7½-month strike that wiped out the World Series for the first time since 1904; and by 2.5 percent in 2004.”

The MLBPA voiced concern  that several organizations, including at least one that received up to $160 million, were pocketing the cash and not using it to enhance their team.

Foreign Policy Update

Yesterday, the U.S. State Department stated that:

“The United States remains deeply concerned by the gross human rights abuses and violations detailed in the UN Human Rights report.  This report on Venezuela illustrates the depth of the despair and humanitarian crisis in Venezuela.  It confirms that Nicolás Maduro and his thugs are committing gross violations of the human rights of the Venezuelan people and depriving them of their basic rights and freedoms through systemic repression, torture, and intimidation.

“One of the most unsettling statistics is that the former Maduro regime’s Special Action Forces killed at least 5,287 people in 2018 and, at minimum, another 1,569 by mid-May, 2019.

“This report follows the alleged torture and killing of Capitán de Corbeta Rafael Acosta Arévalo, a Venezuelan Naval Officer, who died while in the custody of Maduro’s thugs and their Cuban minders.  We renew our deepest condolences to his family and loved ones.

“No dictatorship lasts forever.  Venezuela will soon be free, and those responsible for abuses and violations of human rights in Venezuela will be held accountable. The international community should condemn the illegitimate Maduro regime and stand together to fight against its willful disregard for human rights and impunity.

“We appeal to the countries that have not yet formally recognized Interim President Guaido to do so as soon as possible, and withdraw any lingering support for the former Maduro regime’s de facto hold on power.”

July 5 was Venezuela’s national day. The State Department sent greetings to Juan Guaido, whom Washington considers the legitimate interim president. Maduro, of course, disagrees and clings to power, supported to some extent by foreign militaries. Washington’s greetings to Guaido noted:

“Once again, the Venezuelan people are besieged by dictatorship, undesired foreign presence, and profiteers.  As in the time of Bolivar, Venezuela’s path to democracy is not easy, but you inspire the world with the strength of your voices and tremendous courage.  We are with you in your struggle to reclaim your democratic self-governance and free it from those who have betrayed, oppressed, and robbed the Venezuelan people of the wealth of your great nation. The United States is unwavering in our commitment to realizing the restoration of your democratic future and the establishment of a government chosen by the Venezuelan people through free and fair elections.  You will have our support until then — and beyond as your recovery begins.”

A U.N. Office of the High Commissioner for Human Rights (OHCHR) report issued on July 5 https://news.un.org/en/story/2019/07/1041902 disclosed  that 66 deaths occurred during protests between January and May 2019, of which 52 were attributable to Government security forces, or pro-Government armed civilian groups known as “colectivos.” OHCHR maintains that, as of 31 May 2019, 793 people remained in arbitrary detention, including 58 women.

“They contributed to the deteriorating situation by exercising social control and helping repress demonstrations,” the OHCHR report says of the paramilitary groups.

Allegations of extrajudicial killings by security forces have been “shockingly high”, the report continues, citing the involvement of Government so-called Special Action Forces (FAES). 

In 2018, the Government registered 5,287 killings, purportedly for “resistance to authority” during operations, the report continues, adding that between 1 January and 19 May this year, another 1,569 people were killed, according to Government figures. 

The report also noted that, so far this year, 22 deputies of the National Assembly have been stripped of their parliamentary immunity, as well as to the forum’s leader, Mr. Guaido.

The U.N. also found that:

People ‘have to queue 10 hours per day for food.’

On the plight of ordinary Venezuelans, OHCHR insists that “large sections of the population have no access to food distribution.”

Women are particularly hard-hit, it continues, amid a “progressive scarcity and unaffordability of food” and reports that some are “spending an average of 10 hours per day queuing for food”.

Health provision is also described as “dire, with hospitals lacking staff, supplies, medicines and electricity to keep vital machinery running”. 

Between November 2018 and February 2019, 1,557 people died because of lack of supplies in hospitals, the report notes, citing a national hospital survey.

Minorities lost land to military, armed groups

Indigenous peoples are also shown to have been disproportionately impacted, amid a loss of control of their land to military forces, organised criminal gangs and armed groups. 

“Mining, particularly in Amazonas and Bolivar…has resulted in violations of various collective rights, including rights to maintain customs, traditional ways of life, and a spiritual relationship with their land,” the report adds.

Despite the many violations detailed within her report, the UN human rights chief declared that she was “hopeful”, that the access she had been granted during her trip, as well as the willingness of the Venezuelan authorities to accept the presence of two human rights officers on the ground, marked the beginning of “positive engagement” on the country’s many human rights issues. 

The situation is complex, she said, but “the report contains clear, concrete recommendations for the way forward. I sincerely hope the authorities will take these recommendations in the constructive spirit in which they are made.”

in response to the High Commissioner’s comments, the Venezuelan representative to the Human Rights council dismissed her Office’s report, calling its contents “incomprehensible”, lacking in “scientific rigour” and omitting to mention the “immoral blockade” facing the country.

Recognizing Progressive Oppression

It can no longer be said that these are isolated events by extremist members of the Left/Progressive movement.  They are the very essence of it. And verbal violence must be included, as well.  The manufactured charges drummed up against Trump in the aftermath of the 2016 election, the unsupported  allegations against Brett Kavanaugh, the false labelling as “racist” of every individual who merely disagrees with any left-wing position must be included.  

The bridge of lawlessness was crossed during the Obama Administration, when whole portions of the federal government were hijacked for partisan political purposes. No punishment was ever delivered to Lois Lerner, who used the Internal Revenue Service to assault the Tea Party. Nothing happened to Attorney General Loretta Lynch, who used the justice Department to attack conservatives.

The Progressive Movement has moved beyond misusing government agencies and censoring social media.  It has ensnared the wider culture.  A massive percentage of “entertainment” TV programs convey left-wing propaganda.

Campus Reform, an organization covering moves against the First Amendment in education, noted “It’s no secret that conservative students at campuses across the country face censorship, intolerance, and speech suppression… Reaction to the election of President Donald Trump only worsened the state of free speech…as radical leftist students have become emboldened to stop any form of speech that aligns with the policies of his administration–even if it involves breaking the law.”

Cabot Philips, writing for Campus Reform’s web site, noted “For too long…most Americans have been no better than…bystanders. Standing idly by while thugs and bullies posing as social justice warriors stifle the speech of the few with violence and intimidation. I’ve been on more than 100 college campuses in the past three years fighting for free speech, and I’ve seen those types of people all too often.”

Hopefully not too late, there has been a dawning realization of how far down the path of totalitarianism the Left has gone. The Washington Times reports that Senator Ted Cruz has called for a federal investigation against Portland, Oregon mayor Ted Wheeler, a Progressive who has allowed Antifa to violently assault people in his streets.

Project Veritas has exposed Google’s attempt to rig coverage of the 2020 election, in furtherance of that company’s leftist ideology. the organization has released an expose on Google including undercover video of a Senior Google Executive, leaked documents, and testimony from a Google insider revealing that corporation’s illicit attempt to affect the outcome of the 2020 elections to insure that a candidate who complies with their leftists beliefs wins. The true extent of the descent into violence and oppression by Progressives has been effectively downplayed by left-oriented social and news media. It will take a major awakening by the American public to recognize and react to this massive and growing crisis.

Independence Day’s Larger Significance

July 4, the anniversary of the signing of the Declaration of Independence, is rightfully celebrated as America’s national holiday. In a larger sense, however, it is even more than that.  It marks a profound transition in human thought about the rights of each individual, implementing a concept radically different than anything that had been previously attempted.

“We hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty and the pursuit of Happiness. That to secure these rights, Governments are instituted among Men, deriving their just powers from the consent of the governed.”

That dramatic phrase repudiated the concept and practice that has existed for far too long, that individuals were mere cogs in a larger wheel of society. It is a debate that continues to this day. Far too few nations acknowledge the sovereignty of each man or woman.

Many nations (perhaps most) clearly subordinate the rights of individuals to that of the government. An Edwatch.org study provides an example from the Cuban constitution, which states:

“’Citizens have freedom of speech in keeping with the goals of the socialist society.’” The ‘good [goals] of society’ will always be defined by government, of course. Human rights cease to be genuine ‘rights’ if they can be suspended by the government for any reason…”

Unfortunately, and with disturbing and growing intensity, it is a battle being fought within the United States, the very land where the concept of “Unalienable Rights” was originally instituted.  Some Left-wing journalists, politicians, and judges are engaged in a singular effort to overturn the central tenet of American rights and government, the concept of “unalienable rights” which should not be limited or abolished by elected officials.

News commentator Chris Cuomo disturbingly displayed what has become a major thrust of Progressive political philosophy. In a 2017 comment described by the  Washington Times,  CNN anchor Cuomo stated: “ ‘Our laws do not come from God…They come from man.’ Obviously, Cuomo flunked civics….The framers of the Constitution clearly understood that in order to put certain rights out of the reach of government, whose power they wished to limit, those rights had to come from a place government could not reach.”

The primacy of unalienable rights in America’s governing concept is neither complex nor obscure.  The Declaration of Independence is crystal clear. It is also enshrined in the Bill of Rights, which specifically states in Amendment 9: “The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people.” Amendment 9 recognizes that the government only has those rights specifically provided in the Constitution. The concept of limited federal government is fortified as well by the Tenth Amendment: “The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.”

The concept is not a Republican-partisan one.  In his extraordinary inaugural address, President John F. Kennedy stated: “…the rights of man come not from the generosity of the state but from the hand of God.”

A study by Lonang Institute described unalienable rights as those that are “incapable of being lost or sold. Unalienable rights are retained despite government decrees to the contrary because civil government does not grant them in the first case. Moreover, no future generation may be disenfranchised of any unalienable right by the present generation…The Declaration translated the common principles of equality and unalienable rights into positive law. Civil government was and is obliged to observe the rule of legal equality. It must recognize that all human beings enjoy certain unalienable rights from God–rights that are not created by the civil government, but which that government is nevertheless obligated to protect to the extent that the people articulate such rights in their constitutions or statutes…The modern lament is even more sweeping. Not only are there philosophers who deny these principles, but their protégés are appointed to the judicial bench, they percolate through the state legislature and through Congress, they occupy the state house and [have occupied the] White House, and they teach and are taught in the law schools.”

CONTEMPT OF CONGRESS: THE TOOTHLESS TIGER

This article was prepared exclusively for the New York Analysis of Policy & Government by the distinguished retired judge, John H. Wilson.

It has been a tough month for Attorney General William Barr.  

On June 11, 2019, by a vote of 229-191, the House of Representatives voted to hold AG William Barr in civil contempt of Congress.  At least, that is the breathless way House Resolution Number 430 has been reported in the media.  In reality, the Resolution authorizes “the chair of the Committee on the Judiciary…to initiate or intervene in any judicial proceeding before a Federal court to seek declaratory judgments and any and all ancillary relief…affirming the duty of…William P. Barr, Attorney General…to comply with the…subpoena that is the subject of the resolution…”

The measure arises out of the House Judiciary Committee’s on-going attempts to secure an unredacted copy of the Mueller Report from the Department of Justice.  The Chairman of the Committee, Rep. Jerry Nadler (D-NY), went forward with the Resolution despite receiving an agreement from the Justice Department to provide Congress with more of the evidence upon which the Muller Report is based.  

The next day, On June 12, 2019, the House Oversight Committee voted to actually hold AG Barr in Contempt for his refusal to comply with another subpoena.    Ostensibly, the Committee is investigating the addition of a question regarding citizenship on the 2020 census, a hot-button issue for Democrats.  However, the issue of whether or not this question can be added to the census is currently before the US Supreme Court, with a decision due any day now (as of this writing).   

The Chairman of the House Oversight Committee, Rep Elijah Cummings (D-MD) refused to postpone the Contempt vote, even after being told that the Trump Administration had asserted Executive Privilege over certain documents considered protected by the Attorney-Client privilege. It should be noted that the Trump Administration has also asserted Executive Privilege over many of the documents sought by the House Judiciary Committee.    

Of more concern is the actual holding of AG Barr in Contempt of the Oversight Committee.  The Committee can now recommend to the full Congress that the Attorney General be held in Contempt of Congress.  What would happen next?  Congress can then make a referral of prosecution – to the Department of Justice.  Will AG Barr prosecute himself, or assign an Assistant United States Attorney to prosecute him?

The answer is, not bloody likely.

In fact, the Attorney General, and other Trump Administration officials involved in these Congressional investigations are but pawns in a war being waged against the President by Congressional Democrats.

After the release of the Report of the Special Counsel, Robert Mueller, the reaction among leftists can be best described as…disappointed.  The New York Times reported that to liberals who had “built up fervent hopes that (the report) would bring Mr. Trump down…the report felt like a betrayal.”  The Washington Post’s Ronald Klain asserted that Robert Mueller had failed in his duty by not pursuing Trump and his family more vigorously, and then presaged the current rash of investigations with this concluding statement –  “If Congress allows his report to be the last word about accountability for the president and his people, it will fail its duty as well.” 

 One of the more interesting interpretations of the Mueller Report comes from Eleanor Stavinoha, who believes that “not only did the Mueller report protect the bourgeois state and its ability to reproduce the rule of capital, but the FBI was never going to threaten the state’s legitimacy in the first place.”  Her conclusion?  Capitalism is to blame for the Report of the Special Counsel.    (I’d explain her position further, but then you’d miss out on the fun of following the link and reading this outlandish piece of socialist rhetoric.)

Clearly, President Trump’s opponents had hoped to use the findings of the Mueller Report as the basis for the impeachment of the President.  But the unequivocal nature of the findings of a lack of collusion with the Russian government during the 2016 election, coupled with the equivocal findings on obstruction of justice make for an extremely weak case upon which to base an impeachment.

  Many bad things can be said about House Speaker Nancy Pelosi.  However, she has proven herself to be more politically astute than many Congressional Democrats.  While Alexandria Ocasio-Cortes (D-NY) and Maxine Waters (D-CA) call for impeachment and removal, Speaker Pelosi has repeatedly refused to join this chorus.   

What Nancy Pelosi understands, and the more radical members of her caucus do not, is that an impeachment of President Trump cannot be successful.  As the Mueller Report itself states, “unlike cases in which a subject engages in obstruction of justice to cover up a crime, the evidence we obtained did not establish that the President was involved in an underlying crime related to Russian election interference.”  Further, “although the obstruction statutes do not require proof of such a crime, the absence of that evidence affects the analysis of the President’s intent and requires consideration of other possible motives for his conduct.”   

As every Criminal Lawyer knows, including the attorneys on Speaker Pelosi’s staff, to establish a crime, the prosecution must establish that a person had an intent to commit a crime (unless the crime is one of strict liability, such as Statutory Rape).  If President Trump was not involved in an underlying crime (ie, an attempt to illegally influence the outcome of an election), then his motive for trying to halt the investigation was equivocal at best.

The lack of a clear criminal intent in the President’s actions makes both prosecution for a crime and impeachment problematic at best.  Speaker Pelosi also understands that exoneration after impeachment could strengthen the President’s hand, and make defeating him in 2020 less likely.

Hence, Congressional investigations are the answer – the equivalent of the “death by a thousand cuts.”  Chairman Nadler knows that the majority of the materials he is requesting from the Justice Department are Grand Jury Minutes that are protected from release by federal law – yet, he demands their release from AG Barr.  Chairman Cummings knows that the citizenship question will be decided by the Supreme Court – yet still he demands attorney/client privileged documents and his Committee holds the Attorney General in Contempt.

“The Congress will continue to investigate,” Speaker Pelosi has vowed.  In the meanwhile, Attorney General Barr better get used to being held in contempt by this Congress.

Extensive, numerous attempts at appeasement have thoroughly failed; indeed, they have exacerbated the problem. The Mullahs have interpreted these moves not as overtures of peace, but as indications of weakness. Throughout the eight years of the Obama Administration, nearly every Middle Eastern move made by Washington was geared towards signaling goodwill towards the Tehran regime. Beyond gestures, highly substantive acts were undertaken.  The premature withdrawal of American troops from Iraq; the signing of a nuclear deal which, after a relatively short period of time gave Iran the unchecked ability to develop atomic weapons; the delivery to Iran of pallet-loads of cash without any strings attached; the distancing of Washington from its primary ally, Israel in the region; and the Justice Department’s slow-walking investigations of Iran-connected criminal activity within the U.S.  are just a few headline examples.
